This End User License Agreement (“Agreement”) is a binding agreement between you (“End User” or “you”) and Print Speak Pty Ltd (“Company”). This Agreement governs your use of the Company's customer portal (the “Portal”). The Portal is licensed, not sold, to you.
Subject to the terms of this Agreement, Company grants you a limited, non-exclusive, and non-transferable license to use the Portal for your internal business purposes.
You shall not:
The Portal, including without limitation all copyrights, patents, trademarks, trade secrets, and other intellectual property rights, is and shall remain the sole and exclusive property of Company.
You retain all rights to any data you input into the Portal. You grant Company a non-exclusive license to use, copy, store, and process your data solely for the purpose of providing and improving the Portal services.
Company will handle all personal information in accordance with its Privacy Policy, available at printspeak.com/privacy.
THE PORTAL IS PROVIDED TO END USER “AS IS” AND WITH ALL FAULTS AND DEFECTS WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, COMPANY EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.
This Agreement is effective until terminated by you or Company. Company may terminate this Agreement at any time without notice if you fail to comply with any term of this Agreement. Upon termination, you must cease all use of the Portal.
This Agreement is governed by and construed in accordance with the laws of the State of New South Wales, Australia, without giving effect to any choice or conflict of law provision or rule.
